Welcome to PODgram.ai! These Terms of Service ("Terms") govern your access to and use of PODgram.ai (the "Service"), a Discord bot for generating and preparing print-on-demand artwork using artificial intelligence. By using PODgram.ai, you agree to be bound by these Terms.

1. 📋 Acceptance of Terms​

By accessing or using PODgram.ai through Discord, you confirm that you:

  • Are at least 13 years of age (or the minimum age required in your jurisdiction)
  • Have the legal capacity to enter into these Terms
  • Agree to comply with all applicable laws and regulations
  • Accept Discord's Terms of Service and Community Guidelines

If you do not agree to these Terms, you must not use the Service.

2. 🎨 Service Description​

PODgram.ai is a Discord bot that provides the following features:

  • AI Art Generation: Create images from text descriptions using advanced AI models
  • Background Removal: Remove backgrounds from images for print-on-demand products
  • Vector Conversion: Convert raster images to vector format (SVG)
  • Image Analysis: Generate product descriptions and pricing recommendations
  • Credit-Based System: Usage-based pricing for all operations

3. 💳 Credit System and Pricing​

Initial Balance​

New users receive an initial credit balance of $2.00 USD upon first use of the Service.

Operation Costs​

Each operation consumes credits according to the following pricing:

  • Text-to-Image Generation: $0.06 per image
  • Background Removal: $0.04 per image
  • Vector Conversion: $0.02 per image
  • Image Analysis: $0.01 per analysis

Credit Management​

  • Credits are checked before operations begin
  • Credits are deducted only after successful completion of an operation
  • Pricing may be adjusted at our discretion with notice
  • You can check your balance at any time using the /balance command
  • Additional credits can be purchased through our payment system powered by Stripe

Refund Policy​

  • Credits are generally non-refundable once consumed
  • If a technical error prevents successful completion of a paid operation, credits will be refunded
  • Refund requests must be submitted within 30 days of the transaction
  • We reserve the right to review and approve refund requests on a case-by-case basis

4. ✅ Acceptable Use​

You agree to use PODgram.ai only for lawful purposes. You may use the Service to:

  • Create original artwork for personal or commercial use
  • Prepare images for print-on-demand products
  • Generate product descriptions for your business
  • Explore creative AI capabilities

5. 🚫 Prohibited Use​

You may NOT use PODgram.ai to create, upload, or generate content that:

Illegal Content​

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights of others
  • Contains or promotes illegal activities

Harmful Content​

  • Depicts or promotes violence, gore, or harm to individuals or animals
  • Contains child sexual abuse material (CSAM) or child exploitation
  • Harasses, bullies, or threatens individuals or groups
  • Contains hate speech or promotes discrimination

Adult Content​

  • Contains sexually explicit or pornographic material
  • Depicts nudity or sexual acts
  • Is intended to sexually arouse or gratify

Deceptive Content​

  • Creates deepfakes or misleading content intended to deceive
  • Impersonates real individuals without consent
  • Spreads misinformation or disinformation

Privacy Violations​

  • Uses images of real people without their consent
  • Violates privacy rights or doxes individuals
  • Contains personally identifiable information (PII) of others
  • Infringes on copyrighted works, trademarks, or other IP rights
  • Uses protected brand names, logos, or characters without authorization
  • Violates the rights of any third party

System Abuse​

  • Attempts to reverse engineer, hack, or exploit the Service
  • Uses automated scripts or bots to abuse the system
  • Circumvents credit requirements or payment systems
  • Shares accounts or transfers credits without authorization

We reserve the right to remove content and suspend or terminate accounts that violate these restrictions.

6. 🖼️ AI-Generated Content​

Content Generation​

  • All images are generated using third-party AI models (including Ideogram and others)
  • Generated content may occasionally be inaccurate, inappropriate, or unexpected
  • We do not guarantee the quality, accuracy, or suitability of generated content
  • You are responsible for reviewing all generated content before use

Content Ownership​

  • You retain ownership of the prompts you provide
  • Generated images are licensed to you according to our Content License (see Section 7)
  • We reserve the right to use anonymized usage data to improve the Service
  • We do not claim ownership of your generated content

Content Moderation​

  • Generated content is subject to automated and manual moderation
  • We reserve the right to review, flag, or remove content that violates these Terms
  • Repeated violations may result in account suspension or termination

7. 📜 Content License​

Your License to Generated Content​

For images generated using PODgram.ai:

  • You receive a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute the generated images
  • You may use generated images for commercial purposes, including print-on-demand products
  • You may NOT claim that you created the images without AI assistance if disclosure is required by law
  • The license is subject to your compliance with these Terms

Restrictions​

  • You may not use generated content in ways that violate these Terms
  • You must comply with applicable laws regarding AI-generated content disclosure
  • Some jurisdictions may require disclosure that content is AI-generated

No Exclusivity​

  • Other users may generate similar or identical images using similar prompts
  • We do not guarantee that generated content is unique
  • You are responsible for verifying that your use does not infringe on third-party rights

8. 🔒 Privacy and Data​

Data Collection​

We collect and process the following data:

  • Discord user ID and username
  • Command usage and prompts
  • Generated images and associated metadata
  • Credit balance and transaction history
  • Error logs and technical data

Data Use​

We use collected data to:

  • Provide and improve the Service
  • Process payments and manage credits
  • Monitor for abuse and enforce these Terms
  • Comply with legal obligations

Data Retention​

  • Prompts and generated images may be retained for moderation and improvement purposes
  • Transaction history is retained for accounting and legal compliance
  • You may request deletion of your data by contacting us

9. 🤖 Discord Integration​

Discord Terms​

  • PODgram.ai operates as a Discord bot and is subject to Discord's Terms of Service
  • You must comply with Discord's Community Guidelines when using the Service
  • We are not responsible for Discord's actions, including server bans or account suspensions

Bot Availability​

  • The Service is provided through Discord servers where the bot is installed
  • Server administrators may restrict or remove the bot at any time
  • We may experience downtime or interruptions in service

Server Moderation​

  • Server administrators are responsible for moderating their communities
  • We are not responsible for user behavior on third-party Discord servers
  • Reports of abuse should be directed to server administrators and Discord

10. 🛡️ Intellectual Property​

PODgram.ai Trademarks​

  • "PODgram.ai" and associated logos are trademarks owned by us
  • You may not use our trademarks without prior written permission
  • You may not suggest endorsement or affiliation without authorization

Third-Party Rights​

  • The Service uses third-party AI models and services
  • Third-party providers retain their intellectual property rights
  • You must comply with third-party terms and licenses

If you believe content generated using PODgram.ai infringes your copyright, please contact us with:

  • Identification of the copyrighted work
  • Description of the infringing content
  • Your contact information
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury
  • Your physical or electronic signature

11. ⚠️ Disclaimers and Limitations​

No Warranties​

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, secure, or error-free
  • Warranties regarding the quality, accuracy, or suitability of generated content
  • Warranties that generated content will not infringe third-party rights

Limitation of Liability​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from use of or inability to use the Service
  • Damages resulting from generated content or third-party AI services
  • Damages exceeding the amount you paid for the Service in the past 12 months

Third-Party Services​

  • The Service relies on third-party AI providers and payment processors
  • We are not responsible for failures, errors, or actions of third parties
  • Third-party terms and conditions apply to their respective services

12. 🔄 Changes to Terms​

We reserve the right to modify these Terms at any time:

  • Changes will be posted with an updated "Last Updated" date
  • Continued use of the Service after changes constitutes acceptance
  • Material changes will be communicated through Discord or email
  • You are responsible for reviewing Terms periodically

13. ⛔ Termination​

By You​

You may stop using the Service at any time. Unused credits are generally non-refundable.

By Us​

We may suspend or terminate your access to the Service:

  • For violation of these Terms
  • For illegal activity or abuse
  • For non-payment or fraudulent payment activity
  • At our discretion with or without notice

Effect of Termination​

Upon termination:

  • Your access to the Service will be revoked
  • Unused credits will be forfeited
  • Your license to use the Service terminates
  • Provisions that should survive (e.g., limitations of liability) remain in effect

14. ⚖️ Disputes and Governing Law​

Governing Law​

These Terms are governed by the laws of the jurisdiction in which PODgram.ai is operated, without regard to conflict of law provisions.

Dispute Resolution​

  • You agree to first attempt to resolve disputes informally by contacting us
  • If informal resolution fails, disputes will be resolved through binding arbitration
  • You waive the right to participate in class-action lawsuits

Arbitration​

  • Arbitration will be conducted by a recognized arbitration organization
  • Arbitration will be held in English
  • Each party bears their own costs and fees
  • Small claims court remains available for qualifying disputes

16. 📝 Miscellaneous​

Entire Agreement​

These Terms, along with our Privacy Policy, constitute the entire agreement between you and PODgram.ai.

No Waiver​

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment​

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

Force Majeure​

We are not liable for failures or delays caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, or internet/utility failures.
